AD 54 June 16, 2026 Ct. 28 SG CRM(A) 1589 of 2026 Allowed An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Suti P.S. Case No.150 of 2023 dated 27.03.2023 under Sections 186/153A/295A/296/325/353/333/338 of the IPC, 1860.
And In the matter of: Niten Singha and others ... petitioners Mr. Sourat Nandy ... for the petitioners Mr. K. Bhattacharya ... for the State Learned counsel for the petitioners submits that the petitioners had taken out a religious procession. Suddenly certain people attacked them and pelted stones and brickbats. However, no complaint was filed by the petitioners in this regard. Instead, the police suo motu filed a complaint against the present petitioners. Charge-sheet has been submitted. On 17.04.2026, This Court had granted anticipatory bail to the similarly circumstanced coaccused in CRM(A) 842 of 2026. Learned counsel for the State relies on the case diary and opposes the prayer for anticipatory bail. He also relies on the statements of witnesses and the injury report which, however, does not show infliction of any grievous injury. Considering the above, the other materials available in the case diary, the fact that charge-sheet has been submitted
and similarly circumstanced co-accused were granted anticipatory bail by this Court, I am inclined to grant anticipatory bail to the petitioners.
In the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- (rupees ten thousand) each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on the further conditions that the petitioners shall surrender before the jurisdictional court within four weeks from this date and pray for bail, shall attend the jurisdictional court regularly and shall not threaten or intimidate witnesses. The application for anticipatory bail is, thus, allowed. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
