Petitioner submits most of the accused persons including the principal accused are on bail. He prays for bail. Learned Advocate for the State opposes the bail prayer. He submits petitioner had absconded for three years. The instant case involves murder. Due to abscondence of the petitioner trial could not proceed. His conduct is not appreciable.

In light of the aforesaid facts petitioner cannot be treated on par with other co-accused. Witness action is about to begin. There is substantial progress in the matter since rejection of bail by this Court.

Hence, we are not inclined to grant bail to the petitioner at this stage.

Accordingly, the prayer for bail of the petitioner is rejected.
