The quantum of recovery in the present case is 10 kgs. 304 gms. of Ganja. The petitioner was initially granted bail but subsequently evaded the process of law. By execution of other processes, he has been rearrested in connection with the instant case and is in custody for more than eleven months.

Learned Advocate for the State opposes the prayer for bail. Having considered that the quantum so recovered is of intermediate quantity and the petitioner is in custody for eleven months, I am inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner viz., Sambhu Sk. @ Vishal Sk., shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty thousand only), with two sureties of Rs. 10,000/- each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under the NDPS Act, Barrackpore, North 24-Parganas. If on bail, the petitioner shall be physically present on each and every date so fixed by the learned Special Court and shall not leave the

jurisdiction of the district of North 24-Parganas without prior permission of the learned Special Court.

The application for bail, being CRM (NDPS) 1188 of 2026, is, thus, disposed of.
