It has been submitted that the appropriate forum for resolving the dispute involved in this writ petition is West Bengal Taxation Tribunal.

Accordingly, the department is directed to transmit the records of this case to the West Bengal Taxation Tribunal within four weeks and the interim order of this Court passed on 16th May, 2016 shall be continued for a period of eight weeks. The petitioner is free to take appropriate steps before the tribunal.

The writ petition being W.P.A. No.8877 of 2016 is disposed of.
