30.06.2025 Court No.28 Item No.37 ssi CRM (A) 1751 of 2025 In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Suraksha Nagarik Sanhita in connection with Bhagwangola PS Case No.24 of 2025 dated 06.01.2025 under Sections 108/3 (5) of the BNS 2023.

And In the matter of: Jahangir Alam.

....Applicant/Petitioner.

Mr. Debapriya Samanta ...for the petitioner Mr. Arijit Ganguly Mr. Sharequl Haque ..for the State Learned counsel appearing on behalf of the petitioner submits that the petitioner stands on the same footing as one Talef Sk. @ Talep Sk who was granted anticipatory bail by this Court on 14.05.2025 in CRM (A) 1632 of 2025.

Learned counsel appearing on behalf of the State opposes the application for anticipatory bail but submits that the present petitioner stands substantially on the same footing as the said accused who was granted anticipatory bail.

Considering the materials available in the case diary and fact that the petitioner stands on the same footing as the one who was earlier granted anticipatory bail, I am inclined to allow the application of the petitioner for anticipatory bail.

In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting

Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further conditions that the petitioner shall not threaten or intimidate witnesses and shall not tamper with evidence. The petitioner shall attend the jurisdictional Court on dates fixed.

The application for anticipatory bail is, thus, disposed of. (Jay Sengupta, J.)
