1. The report of the Stamp Reporter as regards jurisdiction in view of Section 21 (1)(a) of Bengal Agra and Assam Civil Courts Act 2000 is accepted and hence the appeal is rejected on the ground that the appeal should be filed before the appropriate Court under the Bengal Agra and Assam Civil Courts Act 2000.

2. The time span in this Court shall be excluded under Section 14 of the Limitation Act. If it is filed within two weeks from date, the Department is to return the certified copy of the same to the learned advocate for the appellant after retaining the Photostat copy. (Soumen Sen, J.)
