G.S.Das Mr. S. Kamal Mr. S. Hossain ... for the Petitioner(s) The petitioner is aggrieved by the fact that inspite of receipt of the information furnished on 21.06.2024, the Inspector-in-charge of Ratua Police Station did not take any action.
According to the petitioner, a construction has been raised over a plot of land which happens to be a government property.
Having considered that the anxiety and agony of the petitioner is that a government land is being encroached, the dwelling house has been raised in front of his residence thereby obstructing his ingress and egress and no steps have
been taken by the police authorities, I am of the opinion that the petitioner, according to the requirement of the statutory provision of law, would approach the jurisdictional Magistrate for necessary directions either under Section 175(3) of the BNSS and/or under Section 223 of the BNSS. In case, such an application is made, the learned Magistrate would consider the same in accordance with law.
So far as the issue relating to demolition is concerned, the representation must be made before the appropriate government authorities so that in case they reach conclusion, suitable assistance may be sought for from the police authorities which the police authorities would respond. Further interference as such is uncalled for by this Court.
With the aforesaid observations, WPA 11629 of 2025 is disposed of.
