No. 29 CHC Rejected C.R.M.(A) 2009 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Balurghat Police Station Case No. 502 of 2017 dated 03.12.2017 under Sections 21(C)/22(C)/25 of the Narcotic Drugs and Psychotropic Substances Act.

And In the matter of : Sanjoy Das ...... petitioner Mr. Kaushik Chaudhury, Ms. Busra Khatun ....for the petitioner Mr. Swapan Banerjee, Mr. Suman De ....for the State The police case is dated December 3, 2017.

Charge-sheet in respect of such police case was submitted on July 23, 2022 inter alia against the petitioner under the NDPS Act, 1985.

Materials in the case diary suggest involvement of the petitioner in the charges levelled against the petition. In such circumstances, in view of the long absconsion of the petitioner, the materials in the case diary, the gravity of the offence and involvement of the petitioner therein, petitioner is

unable to overcome the restriction under Section 37 of the NDPS Act, 1985.

Consequently, we are unable to grant anticipatory bail to the petitioner.

CRM (A) 2009 of 2023 is rejected.
