Heard the learned Counsel for the parties.

This petition for anticipatory bail arises out of Berhampore P.S. case No. 491/2023 dated 18.04.2023 under Section 135(i)(a) of the Electricity Act, 2003.

It is submitted at the Bar that 50 per cent of the amount demanded by the DISCOM has already been paid by the petitioner in the meantime. The xerox copy of the receipt to that effect is filed in Court.

Learned Counsel appearing for the concerned DISCOM also accepts that the petitioner has already deposited Rs. 38,644/- in the case in the meantime.

Regard being had to the facts and submissions and the nature of offence, it is directed that the petitioner shall be released on bail in the event of his arrest by the arresting Officer on such terms and conditions as deemed just and proper in the facts and circumstances of the case. 6.

It is further directed that within 15 days of the receipt of server copy or certified copy of this order the petitioner shall

appear before the I.O. without fail.

Accordingly, the prayer for anticipatory bail of the petitioner is allowed.
