On the basis of the information furnished by the 09.07.2025 Court No. 35 Item No.45 Rakib petitioner already a case has been registered being Kotulpur PS Case no. 114/25 dated 01.04.2025. Police report also reflects that on the basis of a complaint lodged by Umem Salma Begam a case was initiated against the petitioners being Kotulpur PS Case no. 141/25 dated 16.04.2025.

The genesis of the dispute as such reflects that there was a matrimonial dispute.

Learned advocate appearing for the petitioners submits that the petitioners are unable to peacefully enjoy their property.

Having considered the same and the report of the police authorities who have already drawn up a proceeding under Section 126 of the BNSS, I direct the police authorities to continue their surveillance and ensure that the investigation of the cases would independently proceed. However, there should not be any

breach of the peace and/or tranquility and/or any further untoward incident because of the inimical relationship existing between the petitioner and the private respondents.

With the aforesaid observations WPA 11482 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioners.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
