Learned counsel for the petitioner argues that the application for electricity connection to operate a submersible pump of the petitioner was made in the year 2018 and a quotation was raised in 2019. 3.

Even after compliance of formalities, the connection was not given by the respondents.

Learned counsel for the WBSEDCL controverts the timelines and submits that an intimation was given by the petitioner only on April 30, 2024 regarding all installations including the submersible pump, for which the connection was sought, having been done.

Thus, it is not the fault of the WBSEDCL that the matter was delayed so much.

In any event, due quotation has been raised by the WBSEDCL and a period of ninety days is required as an outer limit for the WBSEDCL to give the connection to the petitioner.

Learned counsel for the WBSEDCL places reliance on Clause 4.2D of Regulation No.46 of the WBERC which speaks about the time limits for new connection where augmentation of the distributing main and/or extension of feeder/line/cable will be required.

It is submitted that in the present case, several PCC poles and other installations are required to be installed to give the connection to the petitioner. 9.

Accordingly, WPA 12596 of 2024 is disposed of by directing the WBSEDCL, subject to compliance of all formalities by the petitioner, to give electricity connection to the petitioner within ninety days from the date of compliance of such formalities positively.

10. There will be no order as to costs.

11. Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
