Petitioners are aggrieved by the fact that the private respondent no.8 had been raising illegal construction. To that effect, resistance was made but the private respondent transgressed his limit and allegedly acted in a manner which amounts to an offence.

As none appears on behalf of the State, Mr.

K.J. Yusuf along with Ms. Rupsha Chakraborty, learned advocates, who ordinarily appear on behalf of the State, are directed to represent the State. Their appearance may be regularized by the concerned authorities.

I have considered the nature of contentions advanced in the representation dated 19th April, 2024.

Having considered that more than 14 months have passed since the representation was advanced with the Officer-in-Charge, Chandaneswar Police Station, I direct that if the petitioners are faced with similar inconveniences, they would submit a fresh representation before the police authorities who on receipt of the same would act in accordance with law. With the aforesaid observations, WPA 12550 of 2024 is disposed of.

There will be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
