Perused the affidavit of compliance filed by the Arambagh Municipality on August 21, 2025. It appears therefrom that the allegation of unauthorized construction was considered by the municipality and that an order has been passed. The petitioner is aggrieved by the same.

The Court is of the opinion that validity and legality of the order passed by the municipality cannot be adjudicated in the contempt proceeding.

Accordingly, the contempt application is disposed of. 3.

The Contempt Rule stands discharged.

It will be open for the petitioner to challenge the order of the municipality before the competent forum in accordance with law, if so advised.

Exception filed on behalf of the petitioner to the affidavit of compliance be taken on record.
