The petitioner is aggrieved by the fact that the representation dated 01.05.2023 addressed to the Officer-in-Charge, Canning Police Station was not considered in spite of offence being made out according to the accusations made in the said representation. It is stated that illegally the accused persons have been trying to excavate the land resulting in the character of the land being changed.

In spite of informing the police authorities, the police authorities did not take any steps.

Learned advocate appearing for the State refers to an order dated 01.08.2022 passed in WPA 5228 of 2018 wherein a coordinate Bench of this Hon'ble Court was pleased to grant liberty to the petitioner to approach the competent court or the competent authorities. At the relevant point of time when the petitioner approached this Court in the year 2018, representations of the petitioner before

the District Magistrate, Block Development Officer and the Block Land & Land Reforms Officer were pending.

Having considered that the present writ petition do not enclose any of the documents regarding the outcome of the said representations, the police authorities would only ensure that no breach of the peace or tranquility takes place at the locale and/or any untoward incident results because of the strained relationship existing between the parties. Police authorities are further directed to ensure that in case any of the government officials complains for changing the character of the land, steps be taken in accordance with law.

With the aforesaid observations, the writ petition being WPA 11712 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
