Learned counsel for the petitioner submits that there are certain incurable defects in the writ petition for which he seeks leave to withdraw the same with further liberty to file a fresh one on the self-same cause of action.

The prayer sought for by the petitioner is allowed. Liberty granted to the petitioner to file afresh on the self-same cause of action upon proper and better particulars.

The writ petition is dismissed as 'withdrawn'. 4.
