Ray ..for the respdts.7-10 The petitioner had already approached the learned Sub-Divisional Executive Magistrate, Berhampore under Section 144(2) of the Code of Criminal Procedure with the self-same prayers made in this writ petition.

The learned Sub-Divisional Executive Magistrate had directed the police authorities to enquire into the matter and file a report. The next date has been fixed on August 5, 2022, for the report.

The police authorities had been directed by the said learned Sub-Divisional Executive Magistrate to comply with the order of the learned Civil Court. Under such circumstances, parallel proceeding cannot be encouraged.

The police authorities will act in terms of the order of the learned Sub-Divisional Executive Magistrate, Berhampore.

The writ petition is disposed of.

There will be, however, no order as to costs.

All the parties are directed to act on the basis of the server copy of this order.
