Petitioner seeks anticipatory bail.

Learned Advocate appearing for the petitioner submits that the police submitted charge sheet and, therefore, custodial interrogation of the petitioner is not required. He submits that the petitioner was falsely implicated.

Learned Advocate appearing for the State draws the attention of the Court to the statements recorded under Section 161 of the Code of Criminal Procedure and under Section 164 thereof.

Considering the nature of the incident, the involvement of the petitioner therein and the statement recorded under Section 164 of the Code of Criminal Procedure, we are unable to grant anticipatory bail to the petitioner.

Accordingly, the prayer for anticipatory bail of the

petitioner is rejected.

C.R.M. 5173 of 2021 is dismissed.
