In view of the order under challenge in respect of Spl. No. 01/2017 corresponding to Ashoknagar Police Station Case No. 998 of 2016 dated 02.11.2016 wherein Section 498A of the Indian Penal Code along with another Act being Section 3(ii) of the SC and ST (POA) Act, 1989 is involved, an appeal will lie under Section 14A of the SC and ST (POA) Act, 1989.

Learned advocate for the State expresses his intention to withdraw the present revisional application and file an appeal before the appropriate forum.

Accordingly, the revisional application being CRR 1853 of 2024 is dismissed as withdrawn.

The petitioner is granted liberty to prefer appeal before the appropriate forum.

Pending connected application, if any, is consequently disposed of.

Department is directed to return the certified copy to the learned advocate-on-record of the petitioner after the same is replaced by photostat copy.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
