The petitioners are retired volunteers of the National Volunteer Force. They have received the ex gratia amount on their demobilization at a delayed point of time. The petitioners seek interest on account of such delayed payment of ex gratia.

Reliance has been placed on the order passed by the Hon'ble Division Bench of this Court on 18th January, 2023 in MAT 2093 of 2022 with CAN 1 of 2023 (The State of West Bengal & Ors. v. Habibur Rahaman Halder & Ors.) wherein the Court directed grant of 8% interest on account of such delayed payment.

In line with the aforesaid order, the instant writ petition stands disposed of by directing the respondent no.2, the State Commandant, West Bengal, Bengal National Volunteer Force Directorate, Kalyani to pay simple interest on account of delayed payment of the one-time ex gratia to the petitioners at the rate of 8% p.a. from the next date of demobilization till the date of actual payment, within a period of twelve weeks from the date of communication of this order.

Since the writ petition is disposed of without calling for affidavits, the allegations contained in the

writ petition are deemed not to have been admitted by the respondents.

All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
