Dutta ..... for the respondent no. 8 After hearing learned counsel appearing for the parties, it appears to be an admitted fact that the Excise Authorities have not paid rent in respect of the premises occupied since 2010. The defence is that the Excise Authorities did not know who to pay the rent. Since there are four other legal heirs apart from the petitioner with whom the Excise Authority entered into the rent agreement.

The prayer of the petitioner is that the petitioner's share of the rent be given to petitioner.

The four other legal heirs are represented.

At the suggestion of the counsel, WPA 10920 of 2022 may be disposed of with the direction on the Excise Authorities being the respondent Nos. 2 and 3 to disburse the rent to the five legal heirs of the person with who the agreement was executed after being satisfied of the documentation in that regard. The

petitioner and the private respondents shall produce the Succession Certificate before the concerned respondents within a fortnight from date. The rent shall be disbursed equally to the five legal heirs of the late Paresh Chandra Bhunia within a period of eight weeks from the date on which the Succession Certificate is produced. The concerned respondents shall hear the petitioner within one week from the date on which Succession Certificate is produced by the parties. (Moushumi Bhattacharya, J.)
