In those circumstances, the instant writ petition shall stand dismissed as abated.

Liberty is, however, reserved to the legal heirs of the deceased writ petitioner to file a fresh writ petition on the selfsame cause of action.

Interim order, if any, stands vacated.

There will be no order as to costs.

All parties are directed to act on a server copy of this order on usual undertakings.
