Ria Dutta Sen Mr. Rupayan Deb Ms. Priya Nandy Mr. Rishiraj Gupta ....for the petitioner This application under Article of the Constitution of India is at the instance of the husband praying for a direction upon the learned Additional District Judge, Fast Track, 2nd Court at Sealdah to dispose of the Matrimonial Suit No.111 of 2022 expeditiously.
The learned advocate appearing for the petitioner submits that the petitioner is regularly paying the amount of maintenance directed to be paid to the wife in terms of an order passed in a proceeding under the Protection of Women from Domestic Violence Act, 2005. In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or upon the learned advocates representing the opposite parties before the learned trial judge.
The learned advocate appearing for the petitioner submits that on repeated occasions the crossexamination of P.W.1 was being deferred on the prayer of the learned advocate for the defendants.
From the order sheets appended to this application, this Court finds that July 5, 2025 has been fixed for further cross-examination of P.W.1.
In the light of the submissions made by the learned advocate for the petitioner, CO 1833 of 2025 stands disposed of by requesting the learned Additional District Judge, Fast Track, 2nd Court at Sealdah to make an endeavour to conclude the cross-examination of P.W. 1 as expeditiously as possible but preferably on or before the end of the month of August, 2025 without granting any unnecessary adjournments to either of the parties. After conclusion of cross-examination of P.W.1, the learned trial judge is requested to make an endeavour to proceed with same in accordance with law and dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties.
There will be no order as to costs.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
