1. Affidavit of service filed on behalf of the petitioner is taken on record.

2. In spite of service of notice respondent nos. 4 to 6 are not represented.

3. Learned advocate representing petitioner submits that he is owner of a premises in question and steps were taken for repairing of boundary wall which was obstructed by respondent nos. 4 to 6 prompting the petitioner to approach this Court with the writ petition seeking direction upon the concerned police authorities which would facilitate the petitioner to complete repairing work.

4. State respondents are represented by learned advocate who has filed communication dated 17th June, of Inspector-in-Charge, Monteswar Police Station, Purba Bardhaman

and same is taken on record. Copy of said communication dated 17th June, 2026 is made over to the learned advocate representing petitioner.

5. It is disclosed in the communication dated 17th June, 2026 that on receipt of complaint from the petitioner a GD entry was made being no.

2307 dated 27th March, 2026 and steps were taken under Sections 126/135(3) BNSS to maintain peace.

6. Having considered the submissions made on behalf of the parties it appears petitioner intends to repair boundary wall of his premises which was hindered at the instance of respondent nos. 4 to 6. If petitioner is obstructed from repairing boundary wall he is required to approach the appropriate authority for obtaining permission. Police authority is not the appropriate authority to grant permission thereby permitting the petitioner to repair boundary wall.

7. However, considering the case made out in the writ petition concerned police authorities are directed to maintain peace and tranquility at the locale and see that no untoward incident takes place.

8. With the aforesaid observations writ petition stands disposed of.

9. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
