CESC Authorities and the private respondents are represented.

Learned advocate appearing for the private respondents submits that although the husband of the petitioner is in possession, since the petitioner does not have any locus in respect of the immovable property concerned, no electricity should be granted to the petitioner.

A person in settled possession is entitled to electric supply. Admittedly, the husband of the petitioner is in possession of the immovable property. As the wife of such husband, the petitioner is also in settled possession of the immovable property. Therefore, the petitioner is entitled to electric supply at the premises

concerned. CESC Authorities are agreeable to provide electricity supply to the petitioner. In such circumstances, CESC Authorities will proceed to provide electric supply to the petitioner forthwith upon compliance of all formalities by the petitioner and subject to payment of all costs charges and expenses for the same. In the event, CESC Authorities are obstructed by any person in providing electric supply to the petitioner, they are at liberty to approach the local police authorities for protection. Local police will render adequate police protection to the CESC Authorities. It is expected that entire exercise is concluded within a fortnight from the date of compliance of formalities and payment of all costs, charges and expenses.

WPA 12284 of 2021 is disposed of accordingly. (Debangsu Basak, J.)
