Re: CAN 5 of 2020 and CAN 6 of 2020 Let affidavits be exchanged in each of the applications (CAN 5 of 2020 and CAN 6 of 2020) according to the following directions:- Affidavit-in-opposition by 25th April, 2022.
Affidavit-in-reply may be filed by 10th May, 2022.
List this appeal along with the connected applications on 16th May, 2022.
We record that on 12th April, 2016 a Division Bench of this court granted 2 weeks time to the appellants to remove the defects "failing which the appeal stands dismissed without reference to the Bench".
The defects were not cured and the appeal was dismissed on 27th June, 2016 by the Lawazima court.
With the dismissal of the appeal, the interim order in the appeal also perished. There is no subsisting interim order in the appeal. After 4 years of dismissal of the appeal for nonprosecution, the present applications for revocation of those orders have been made.
We make it clear that while issuing directions of filing affidavits in these applications, we are not granting any interim order.
