Learned advocate appearing for the petitioner submits that the petitioner is in custody for about 94 days and charge-sheet has been submitted before the jurisdictional court. Learned advocate for the State opposes the prayer for bail and submits that the injuries inflicted by the present petitioner is grievous and it is the present petitioner who inflicted the vital blow. I have taken into account the injuries which have been inflicted. Although the conduct of the petitioner is not very encouraging, however, the detention of the petitioner is unwarranted in the facts of the present case. As such, he may be released on imposing stringent conditions.

Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Golam Murtuja @ Murtuj shall be

released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned ACJM, Lalbagh, Murshidabad. If on bail, the petitioner shall be physically present on each and every date before the court and shall not leave the jurisdiction of the district of Murshidabad without prior permission of the court. Petitioner shall not enter the jurisdiction of Lalbagh Police Station without prior permission of the court and shall till further orders meet with the Officer-in-Charge/Inspectorin-Charge of the police station where he would be residing. The attendance and/or acknowledgement at the police station would be informed to the jurisdictional court on the date so fixed. With the aforesaid observations, CRM(M)1284 of 2026 is allowed.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
