Case No.604 of 2021 dated 22.08.2021 under Sections 302 and 34 of the Indian Penal Code, corresponding to G.R. Case No.350 of 2021.
And (Rejected) In the matter of: - Bimal Sardar ...petitioner.
Mr. Mrinal Kanti Mukherjee ... for the petitioner.
Mr. Saswata Gopal Mukherji, Ld. PP Mr. Partha Pratim Das Ms. Manasi Roy ...for the State.
Petitioner prays for anticipatory bail.
Learned Advocate appearing for the petitioner submits that the petitioner was falsely implicated.
Learned Advocate appearing for the State draws the attention of the Court to the materials in the case diary. He submits that specific role in the incident was attributed to the petitioner on the statement of the de facto complainant who is the eye-witness in the incident.
Considering the materials in the case diary and considering the gravity of the offence and the involvement of the petitioner therein as transpiring from the materials in the case diary, we are unable to enlarge the petitioner on anticipatory bail.
Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
C.R.M. (A) 2898 of 2022 is dismissed.
