1. A report has been filed on behalf of the State. Let that be taken on record. The statement of the defacto complainant wife, as recorded, has been annexed with the report whereby the defacto complainant has specifically stated that the matter has been settled with her husband and already an application for divorce has been applied. Previously also, on behalf of the petitioners, a written instruction is placed before this Court to the effect that the petitioner is not willing to proceed with the matter.
2. Therefore, in view of the instructions given by the petitioners as well as the report submitted by the State before this Court today, prima facie, it is seen that the settlement has been arrived at between the parties and a divorce petition is pending. Considering the facts and circumstances, this Court is of the view that keeping the matter pending would be of no use since the matter has been settled. Hence, the revisional application is disposed of. The proceeding pending before the learned court being G.R. Case No.96 of 2022
arising out of Kharagpur Local Police Station Case No.23 of 2022 dated January 10, 2022 be quashed.
3. All parties shall act on the server copies of this order duly downloaded from the official website of this Court.
4. Criminal Section is directed to supply certified copies of this order to the parties, if applied for, upon compliance of all necessary formalities.
