The revisional application was preferred in connection with Beliaghata P. S. Case No. 75 of 2016 which is pending before the learned Judicial Magistrate, 3rd court, Sealdah.

Record reflects that the case has not progressed, although the same was initiated in the year 2016. Last of the orderesheets of the learned J.M, 3rd court, Sealdah reflects that the witnesses are not appearing. A report was called for from the Officer-in-Charge, Beliaghata PS. The concerned Officer, Beliaghata PS has submitted a report and it reflects from the report that all the witnesses except the Investigating Officer(who has expired) are available. Accordingly, I direct the learned J. M., 3rd court, Sealdah to henceforth issue summons through the Officerin-Charge, Beliaghata PS who would ensure regarding the availability of the witnesses on the date so fixed.

Having considered the time consumed, I direct the learned Magistrate to fix a schedule consisting of three dates and fix such schedule once in every fortyfive days so that the trial of the case can be taken to its logical conclusion within a reasonable period of time.

All the stake-holders would cooperate with the trial court to conclude the

trial at the earliest.

With the aforesaid observations, the revisional application being CRR 1848 of 2024 is disposed of.

Pending applications, if any, are consequently disposed of. Let the report submitted by the State be kept with the record., All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
