Petitioner Mr. Tapodip Gupta Ms. Usashi Chattopadhyay Mr. Golam Ahammed ... ... for the petitioner Mr. Gurudas Mitra Mr. Utsav Dutta ... ... for the State Learned Advocate appearing for the petitioner submits that a coaccused was granted bail in CRM (NDPS) 799 of 2026 on the foundation reflected in the evidence of PW 3 and PW 7 which according to the order reflects that the prosecution case has been partially diluted. Learned Advocate for the State opposes the prayer for bail as the subject matter of the present case relates to recovery of 90.270 kgs. of Ganja.

I have taken into account the spirit of the order in CRM (NDPS) 799 of 2026, petitioner is the driver of the vehicle and the same principle shall also apply to the present petitioner. In view of the aforesaid, I direct release of the present petitioner viz., Nowsad Ali Mondal @ Nausad Ali Mandal on the same terms and conditions on which Mir Kasem Mondal, another accused was released on bail in CRM (NDPS) 799 of 2026.

With the aforesaid observations, the application for bail being CRM (NDPS) 1194 of 2026 is allowed.

Report filed by the State is taken on record. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
