It is fairly submitted by counsel for the State that the SDO, Kharagpur has acted without jurisdiction. Mr. Amal Kumar Sen, learned Senior counsel for the State further submits that the SDO, Kharagpur only acted in good faith in trying to resolve the dispute between the petitioner and the private respondents. It is further submitted that the parties did appear before the SDO, Kharagpur but no order had passed.

This Court notes with disbelief the arrogance of the SDO, Kharagpur. It is not understood under what law the SDO, Kharagpur had summoned the petitioner and the private respondents. It is also not understood under what authority the SDO, Kharagpur has attempted to resolve an ongoing dispute between the petitioner and the private respondents.

Mr. Sen has requested the Court to show leniency towards SDO. This Court is of the view that the conduct of the SDO, Kharagpur must be investigated by the District Magistrate, Paschim Medinipore.

The District Magistrate, Paschim Medinipore shall immediately look into this matter and take appropriate steps against the SDO, Kharagpur in accordance with the available statute and/or the relevant rules.

A copy of the document addressed to the SDO, Kharagpur by the private respondent, produced by Mr. Sen is taken on record.

With the observation, the writ petition is disposed of.

There shall be no order as to costs.
