The petitioners of the present application under Section 24 of the Code of Civil Procedure are the plaintiffs in Title Suit No. 271 of 2018 (Amal Adak & Ors. vs. Partha Adak & Ors.) pending before the 1st Court of learned Civil Judge, (Junior Division) at Uluberia, District- Howrah.

The petitioners by the present application are seeking withdrawal of the said suit from the said Court and transfer of it to any other Court competent to try and dispose of the said suit on the ground Sri Partha Adak, the defendant no. 1 in the said suit, is a practicing advocate of Uluberia Court and he is influencing the advocate engaged by the plaintiffs. The allegation made in the application under Section 24 of the Code of Civil Procedure is absolutely bogus, more so, not supported by any material. C.O. 1372 of 2021 is, therefore, dismissed with costs of Rs. 5,000/- to be paid by the petitioners in favour of the State Legal Services Authority, West Bengal, which will be earmarked for the Mediation

Fund kept with the State Legal Services Authority, West Bengal.
