As none appears on behalf of the State, Ms. Rupsha Chakraborty, learned advocate, who ordinarily appears for the State, is directed to represent the State. Her appointment may be regularised by the concerned authorities.

The petitioners have approached this Court with prayers relating to Kotwali Police Station Case No.

388/2017 dated 15.05.2017.

The basic allegation of the petitioners was against the police authorities as the police authorities did not investigate the case properly. Records also reflect that the petitioners earlier approached this Hon'ble Court and a coordinate Bench on 06.09.2018 in W.P. 28875(W) of 2017 was pleased to direct the investigation to be completed within a specified period of time. Records reflect that the investigating agency on completion of investigation submitted

Final Report as Mistake of Fact with the prayer that if any clue is found in near future the case would be reopened. The petitioners thereafter approached the learned sessions court and in a Criminal Revision No. 717 of 2021, Naraji petition of the de facto complainant was directed to be considered by a senior police officer not below the rank of Inspector. The petitioners made representations to all the superior officers of the police including the Director General of Police and the Superintendent of Police.

However, having regard to the fact that such representations were made in the month of March, 2023, I am of the view that the petitioners, if are still aggrieved, would address their grievance before the jurisdictional court already in seisin of the issue.

With the aforesaid observations, the writ petition being WPA 11769 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
