1. Affidavit of service filed on behalf of the petitioner is taken on record.

2. By the present writ petition, the petitioner seeks for a direction upon respondent no. 3, South 24 Parganas Zilla Parishad to demolish the unauthorised construction undertaken by the private respondent over a plot of land being R.S. Plot No. 123, Mouza Kakdwip, J.L. No. 39, Sheet No. 01, Police Station Harwood Point (Coastal), District South 24 Parganas which is a road maintained by the South 24 Parganas Zilla Parishad.

3. Learned counsel appearing for the petitioner contends that private respondent has undertaken an unauthorised construction over the plot of land encroaching upon the Zilla Parishad road and informs

the Court that the proceedings have already been initiated by respondent no. 3, South 24 Parganas Zilla Parishad.

4. In view of the above, the present writ petition being no. WPA 11792 of 2025 is disposed of directing respondent no. 3, South 24 Parganas Zilla Parishad to dispose of the proceedings initiated and take it to its logical conclusion in terms of Section 160A of the West Bengal Panchayet Act, 1973 within a period of six weeks from the date of communication of this order in accordance with law.

5. Learned advocate for the petitioner is directed to communicate this order to respondent no. 3, South 24 Parganas Zilla Parishad, for necessary compliance.

6. Consequently, connected applications, if any, also stand disposed of.

7. Interim orders, if any, stand vacated.

8. There will be no order as to costs.

9. Urgent certified photostat copy of this order, if applied for, shall be given to the parties as expeditiously as possible on compliance of all necessary formalities. (Bivas Pattanayak, J.)
