Sanjib Kumar Mukhopadhyay, learned Advocate for the petitioner submits that the order dated 13th October, 2023 was challenged in appeal before the Hon'ble Division Bench in MAT 2245 of 2023. While disposing of the appeal the Hon'ble Division Bench has disposed of the present writ petition. The petitioner has preferred a review petition before the Hon'ble Division Bench which is pending. Since the review petition could not be listed and heard out due to change in constitution of Hon'ble Division Bench, he seeks that the matter be made out of list for the time being with a liberty to mention.

In view of such submission, let the matter go out of list with liberty to mention.
