Petitioner has prayed for expediting the process of the proceedings under Section 125 of the Code of Criminal Procedure being ACM-613 of 2021 pending before the learned Judicial Magistrate, 8th Court, Alipore.

Records reflect that on 16th February, 2024 learned Magistrate has fixed date on 28th June, 2024 for hearing of the application for interim maintenance. Records also reflect that on the said date affidavit of assets and liabilities and written objection has been filed by the opposite party.

In view of the affidavit of assets and liabilities and written objection filed by the opposite party, the learned Judicial Magistrate, 8th Court, Alipore is directed to first dispose of the application for hearing of interim maintenance on 28th June, 2024 or within a fortnight thereafter. The learned trial court will not stretch the timeline beyond 12th July, 2024.

I find that the case was instituted in the year 2021. As

such, after pronouncing its verdict in respect of the prayer for interim maintenance, the learned trial court would fix one date in every two months so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. No unnecessary adjournment be granted to any of the parties. The trial of the case would continue in spite of any resolution of the local bar and the participating advocates in any manner whatsoever will not stall the proceedings.

With the aforesaid observations, CRR 1854 of 2024 is disposed of.

Pending connected application, if any, is consequently disposed of.
