Md Shakil Hossain v. State Of West Bengal
11.06.2025 Ct.No.34 b.das Rejected C.R.M. (R) 39 of 2025 In Re : An application for bail under Section 483 of BNSS, 2023 filed in connection with Kumarganj Police Station Case No.308 of 2022 dated 20.09.2022 under Sections 468/471 of the Indian Penal Code read with Sections 13(2)/14(a)(b)(c)/14(c) of the Foreigners Act. And In Re :
Md. Shakil Hossain ... Petitioner.
Mr. Kaushik Choudhury ... for the petitioner.
Mr. Ranadeb Sengupta Ms. Afreen Begum ... for the State.
Heard learned counsels for the parties.
The petitioner is admittedly a Bangladeshi national. Learned counsel for the petitioner submits that there has been no further progress in trial after the bail prayer of the petitioner was turned down by this Court on 8th January, 2025. He is suffering incarceration for a prolonged period. Learned counsel for the State opposes the prayer and submits that two dates were fixed for evidence after the earlier order of this Court but witnesses could not be examined due to adjournment sought on behalf of the co accused.
This Court is also informed that the petitioner obtained fake Aadhar card, Voters' Identity card, PAN card etc. and purchased a two wheeler producing the said forged documents.
Since the petitioner is admittedly a Bangladeshi national whose passport and Visa expired, this Court is not inclined to release him on bail at this stage. However, considering the period of detention of the petitioner, the learned trial Court is directed to take the proceeding to its logical conclusion as expeditiously as possible without granting any unnecessary adjournment to either of the parties, in accordance with law. The application for bail is thus disposed of. Case diary be returned.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
