C.R.M. The petitioner is in custody for more than 6 years and renews his prayer for bail. Learned counsel for the petitioner submits that despite direction of this Court to conclude the trial as expeditiously as possible, preferably within two years from the next date fixed for recording evidence without granting any unnecessary adjournment to either of the parties, trial is yet to conclude.

Opposing the prayer, learned counsel for the State takes this Court to an order dated 13th February, 2025 turning down the prayer of the co-accused wherein this Court recorded that out of 62 days of trial as on that date defence took 16 adjournments and the prosecution took adjournment on two days. On 6 dates of trial there were

resolutions of the bar and the presiding officer was not available for about 15 days.

The petitioner's prayer was turned down on merits by this Court earlier. Even after that there has been delay in progress of trial due to several adjournments taken by the accused persons before the learned trial Court. In view of the contribution of the defence in delay in trial, this Court is not inclined to favour the petitioner with an order of bail at this stage.

Accordingly, the prayer for bail is rejected at this stage.

Learned trial Court is directed to expedite the trial without granting any unnecessary adjournment to either of the parties.

The application for bail is disposed of.
