Learned advocate appearing for the CESC authorities submits that the CESC authorities attempted to provide electricity supply to the petitioner and were resisted by the private respondent in doing so.

The petitioner seeks new electricity connection. CESC authorities are not objecting to grant the petitioner the same.

Since the CESC authorities faced obstructions in providing electricity supply to the petitioner, they are liberty to take police assistance, if they are obstructing any further. CESC authorities will provide the petitioner with a new electricity connection, in accordance with law, subject to the petitioner paying all costs, charges and expenses with regard thereto and complying with all formalities. In the event, CESC authorities approach the local police for assistance, they will provide adequate police protection.

It is expected that the CESC authorities provides electric supply to the petitioner within a fortnight from the date of compliance of all formalities by the petitioner and payment all costs, charges and expenses.

WPA 12378 of 2021 is disposed of accordingly. All parties shall act on the server copies of this order duly downloaded from the official website of this Court. (Debangsu Basak, J.)
