Criminal Revisional Jurisdiction C.R.R 1565 of 2021 Firoz Ahmed -versus- Sagar Infralogistics Pvt. Ltd. & Ors.

Re : An application under Sections 397/401 read with Section 482 of the Code of Criminal Procedure.

The revisional application was preferred challenging the order dated 28th July, 2021 passed by the learned Executive and Metropolitan Magistrate, 10th Court, Calcutta in M. Case No. 337 of 2021 under Section 144(2) of the Code of Criminal Procedure. . Learned Executive Magistrate was of the opinion that the dispute referred to in the application is a civil dispute for which the petitioner should approach the competent forum and thereafter rejected the application under Section 144(2) of the Code of Criminal Procedure.

Having regard to the time period which has elapsed in the meantime, I am of the opinion that no interference is called for in the present revisional application.

Accordingly, the revisional application being CRR 1565 of 2021 is dismissed.
