Mr. Chakraborty submits that although a case being Kalyani P.S. Case No. 465 of 2025 dated 9th May, under Sections 329(4)/126(2)/232/115(2)/74/3(5) of the BNS was registered based on a complaint lodged by the petitioner against the private respondent, the police authorities are not conducting the investigation fairly or properly. He, therefore, prays for an appropriate direction upon the concerned Investigating Officer to conclude the investigation expeditiously.

Mondal, learned advocate representing the State, submits that notices under Section 35(3) of the BNSS were issued to

the petitioner on multiple occasions, and on one occasion, such notice was affixed to the front gate of the petitioner's residence. However, the petitioner failed to appear at the police station or extend cooperation to the Investigating Authority, which has hindered the progress of the investigation.

In response, Mr. Chakraborty submits that the petitioner is now willing to cooperate with the Investigating Authority and will attend the police station as and when required.

Having heard the submissions of the respective parties, the writ petition is disposed of with a direction to the Investigating Officer to bring the investigation in connection with Kalyani P.S. Case No. 465 of 2025 dated 9th May, 2025 to its logical conclusion expeditiously and without any unnecessary delay.

The petitioner is also directed to extend full cooperation to the Investigating Agency. There shall, however, be no order as to costs.
