Mr. Muhammad Obaid ... for the Petitioners. The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite parties, as such, service of notice of the present application upon the said opposite parties is dispensed with. The plaintiffs in a suit for declaration of title are the petitioners of the instant application under Article 227 of the Constitution of India. The said suit being Title Suit No.79 of 2023 is pending before the 1st Court of learned Civil Judge (Junior Division) at Barasat, District: 24 Parganas (North).

The petitioners are complaining delay in disposal of an application under Section 151 of the Code of Civil Procedure filed by them for police help to implement the ad-interim order of injunction passed in the suit and are praying a direction for expeditious disposal of it.

The learned Trial Judge therefore is requested to dispose of the said application as well as the pending application for injunction as expeditiously as possible in accordance with law, if those are otherwise ready for such disposal and in doing so, shall not entertain the prayer of the parties for any unnecessary adjournment. CO 1627 of 2024 is disposed of with the above terms without any order as to costs.
