Petitioners have challenged the continuance of the proceedings particularly in respect of charge-sheet which has been submitted in connection with Purbasthali Police Station Case No.41/2018 dated 06.02.2018 under Sections 452/323/326/379/504/506/34 of IPC pending before the court of learned Judicial Magistrate, 2nd Court, Kalna. Learned advocate for the petitioners submits that there are disputes between the parties for which litigations are pending before the civil court.

However, without entering into the zone of contentions raised by the petitioners, I find that charge sheet has been submitted in the year 2018, subsequently charge has also been framed.

Having regard to the same, no interference is made out.

Petitioners would be at liberty to take up the issues canvassed in the present case at the time of trial and final arguments of case.

Learned trial court would independently consider the points so canvassed without being influenced by any observations made by this Court.

With the aforesaid observations, CRR 2015 of 2022 is disposed of.

Pending application, if any, is consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified copy of this order, if applied for, be supplied to the parties upon compliance of such requisite formalities.
