Accordingly, Mr. Arun Kumar Halder, learned counsel appearing for the applicant/petitioner, the petitioner could not have been represented before the Court on the particular date due to communication gap between the learned advocate and his clerk, for which, the writ petition would not have any role to bear. The reason shown in the petition CAN 7838 of 2017 being beyond the control of the petitioner are substantive and sufficient.
Hence, the prayer of the applicant/petitioner in the said application is allowed.
Let the order of this Court passed in W.P. No. 12981 (W) of 2017 dated July 19, 2017 be recalled.
Let the writ petition being WPA No. 12981 of 2017 be restored in its original file and number.
Let the matter appear under the heading "Old Hearing Matters" on January 30, 2025.
