Mrinal ..for the petitioner Mr. Nilanjan Bhattacharjee, Sr. Standing Counsel Ms. Jayita Dhar Chakraborty ..for the State After going through the averments made in the writ petition and the reliefs claimed therein this Court finds that the petitioner is aggrieved by the construction of a brick wall by the private respondents on the property of the petitioner. The petitioner has sought for a direction upon the Panchayat Pradhan for appointment of an Engineer Commissioner to measure and determine the alleged encroachment. The dispute as to encroachment of a raiyati property by a private party cannot be the subject matter of a writ petition. The dispute involved in this writ petition is purely a civil dispute.

Accordingly WPA 12051 of 2026 stands dismissed as not entertained.

This order shall not preclude the petitioner from approaching the proper forum in accordance with law for appropriate relief.

There shall be however no order as to costs.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
