Report dated 25.07.2023 submitted by Mr. Saryati Datta, learned advocate appearing for the State be kept on record. The report encloses the statement which has been recorded by one Kishore Modak, SI of Belur Police Station. It reflects therein that the lady Naina Agarwal has stated that there has been a decree of mutual divorce with the petitioner Deepak Aggarwal and she is not inclined to pursue the case relating to Belur Police Station Case No. 165 of 2020 dated 10.09.2020.

The dispute and difference in this case arose out of matrimonial discord for which the case was registered under Sections 498A/406/506/34 of the Indian Penal Code and the investigating agency, on conclusion of investigation, submitted charge-sheet under the same sections. In view of the statement recorded and the submissions made that settlement has been arrived at between the parties, I am of the opinion that further continuance of the proceeding being

Belur Police Station Case No. 165 of 2020 dated 10.09.2020 including the charge-sheet filed therein is unwarranted and as such, the same is quashed.

The revisional application being CRR 1804 of 2023 along with CRAN 1 of 2023 is, thus, allowed.

Other pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
