1. At the time of call accommodation is prayed for on behalf of petitioner. However, on perusal of the writ petition it appears that prayer is made for registering FIR based on complaint lodged. There is an alternative remedy available under Section 175(3) of BNSS, 2023, if petitioner is aggrieved due to inaction on the part of the concerned police authority in not registering FIR. In this regard reliance is placed on the judgment of Hon'ble Supreme Court reported in (2007) 6 SCC 171 (Aleque Padamsee and Others vs. Union of India & Others).

2. Hence, writ petition is not entertained and same stands dismissed.

3. However, this order shall not preclude the petitioner to approach jurisdictional Magistrate in pursuit of remedy.
