On the recommendation of the Selection Committee, the petitioner was appointed on December 23, 2015 as Generator/Pump/Gas Plant Operator cum Mechanic (Day Shift) in a Pay Band of Rs.4,900-16,200/- with Grade Pay of Rs.1,800. The petitioner is alleging that he has skill, experience and academic qualification to be a Group "C" staff of the college but his scale of pay has been fixed at a lower grade.

Mr. Chakraborty, learned advocate for the petitioner submits that college has approached the Director of Public Instruction Department of Higher Education, Government of West Bengal, the respondent no.3 herein, with a proposal to rectify the scale of pay of the petitioner.

He prays that the respondent no.3 may be directed to consider the said proposal.

The copy of the letter dated January 05, 2017 of the Principal the respondent no. 4 herein, is filed on behalf of the said college, let it be kept with the record.

It appears that the respondent no. 4 by the said letter has communicated the decision of the Governing Body of the College to change the category of the petitioner from Group "D" to Group "C". The respondent no. 3 is directed to consider the said request of the respondent no. 4 in accordance with law as expeditiously as possible preferably within a period of four weeks from the date of communication of this order.

WPA 12671 of 2024 is disposed with the above terms without any order as to costs.

It is however, made clear that this Court has not gone into the merit of the claim of the petitioner. Parties to act on the server copy of this order duly downloaded from the official website of this Court.
