For the State The writ petition has been preferred by the petitioner alleging that his elder sister, namely, Mir Sheuli (in short, Sheuli) went missing on and from 20th March, 2021. A complaint to that effect was lodged. As no steps were taken, an application under Section 156(3) of the Code of Criminal Procedure (in short, the Code) was preferred and on the basis of the order passed in the same, Goghat Police Station Case No. 82 of 2021 dated 14th April, 2021 under Sections 363/365/379/34 of the Indian Penal Code was registered. The police authorities, however, did not take appropriate steps to recover the victim girl and as such, he has approached this Court.

Records reveal that the writ petition was preferred on 3rd August, 2021. No one appears today on behalf of the petitioner and no accommodation has been sought for.

Chatterjee, learned Additional Public Prosecutor appearing for the State respondents submits that in course of investigation in Goghat Police Station Case No. 82 of 2021 dated 14th April, 2021, Sheuli was recovered and her statement under Section

164 of the Code was recorded wherein she stated that she was married to one Mir Raihan and that she was not abducted and kidnapped by anyone. The victim girl is presently residing at 172, Sibpur Bidhansabha Kendra (A/C), Ward No. - 48, P.S. Jogacha, District - Howrah. Upon completion of investigation, final report has also been filed in the said Goghat Police Station Case No. 82 of 2021 dated 14th April, 2021. Sheuli has also filed a complaint against her in-laws and the same was registered as Goghat Police Station Case No. 191 of 2021 dated 31st July, 2021 under Sections 498A/406/354 of the Indian Penal Code. Let the report, as filed today in Court, be kept on record. In the said conspectus and as the victim girl has already been recovered, no further order is required to be passed in the present writ petition and the same is, accordingly, disposed of.

There shall, however, be no order as to costs. All parties shall act on the server copies of this order duly downloaded from the official website of this Court.
