Affidavit of service filed by the petitioners is taken on record.

The petitioners allege that the private respondent is raising construction in the plot in question classified as "Jal" without conversion of the same and without obtaining sanction from the concerned Panchayat.

Learned counsel for the private respondent produces a copy of a conversion certificate as well as sanctioned building plan which demonstrate that the plot in question has been converted to "Bastu" and sanctioned building plan has been granted in favour of the private respondent on 7th April, 2025 for raising construction therein. Therefore it cannot be said that the construction raised by the private respondent is without conversion of the land or without sanctioned plan.

In view of the above, nothing further remains to be dealt with in the writ petition. The same is disposed of.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
